SUPREME COURT JUDGMENT ON TENDERS
In a recent judgement, the Honourable Apex court has held that in matter of tenders, the tender issuing authority is the best person to interpret the documents of tender and the terms and conditions contained therein. The matter came up before the Honourable Supreme Court of India in Utkal Suppliers versus Kanak Durga Enterprises. It has been further held by the Honourable Apex court that the authority which floats the contract/tender is the only appropriate authority to judge as to how the documents have to be interpreted. This judgement will go along way in clarifying the doubts in the minds of the business community who approach the courts blindly.
